1. Agreement to These Terms
By using rickysautomations.com, submitting a form on the site, signing a client service agreement, or using any service provided by Ricky's Automations (the "Services"), you agree to these Terms of Service. If you use the Services on behalf of a business, you represent that you are authorized to bind that business to these terms.
Where a signed client service agreement exists, that agreement controls if it conflicts with these terms. These terms cover everything the agreement does not.
2. The Services
Ricky's Automations provides business automation services, including recurring social media advertising automation across platforms such as Facebook, Instagram, X, and TikTok through the Ricky's Automations client publishing studio; B2B lead generation; reporting automation; and related consulting work. Service scope, pricing, and schedules are described on the website or in your client agreement.
The Ricky's Automations client publishing studio prepares promotional content (text, images, and video) for your business and lets you review and approve content before it is sent to a connected social media account. You can request changes, pause posting, or disconnect a platform at any time.
3. Your Accounts and Connected Platforms
You retain full ownership and control of your social media accounts, ad accounts, websites, and other connected systems. When you connect an account (for example, by granting platform access through an official authorization flow such as OAuth), you authorize Ricky's Automations to use only the permissions shown in that authorization flow. TikTok publishing requires your explicit approval before each post is sent.
You may revoke access at any time through the platform's own security settings or by written request. Use of each connected platform remains subject to that platform's own terms — including the terms and community guidelines of Facebook, Instagram, X, TikTok, and Google.
4. Client Content and Responsibility
You are responsible for the accuracy of the business information you provide (offers, pricing, claims, contact details) and for having the rights to any names, logos, and materials you supply. Content generated for you is reviewed against the information you provide, and you may request revisions or removal of any post.
You agree not to use the Services for anything unlawful, deceptive, or infringing, and not to request content that violates a platform's rules. Ricky's Automations may decline or remove content that would break the law or a platform's policies.
5. Fees, Billing, and Cancellation
Current pricing is listed on the website and in your client agreement. Monthly services bill on a recurring basis through the payment method you select (such as ACH autopay or secure checkout). Platform ad spend stays on your own billing method unless agreed otherwise in writing.
You may cancel a monthly service effective at the end of the current billing month by written notice. Fees already incurred are not refunded unless your agreement says otherwise or the law requires it.
6. Intellectual Property
Content created for your business under a paid service (posts, images, videos, and captions) is yours to use once the applicable fees are paid. Ricky's Automations retains ownership of its own tools, software, templates, and know-how, including the client publishing studio itself.
7. Disclaimers
The Services are provided on an "as is" and "as available" basis. Ricky's Automations does not guarantee specific business results, engagement levels, lead volumes, or ad performance, and is not responsible for outages, policy changes, API changes, or account actions taken by third-party platforms such as Facebook, Instagram, X, TikTok, or Google.
8. Limitation of Liability
To the fullest extent permitted by law, Ricky's Automations' total liability for any claim arising out of the Services is limited to the amount you paid for the Services in the three (3) months before the event giving rise to the claim. Ricky's Automations is not liable for indirect, incidental, special, or consequential damages, or for lost profits or lost data.
9. Termination
Either party may end the Services as described in Section 5 or in your client agreement. Ricky's Automations may suspend or end Services for non-payment, unlawful use, or material breach of these terms. On termination, platform access granted to Ricky's Automations should be revoked, and any content already delivered remains yours under Section 6.
10. Privacy
How information is collected and handled is described in the Privacy Policy, which is part of these terms.
11. Changes to These Terms
These terms may be updated as the Services, tools, or legal requirements change. The updated version will be posted on this page with a new "Last updated" date. Continued use of the site or Services after an update means the updated terms apply going forward.
